Position Title: Legal Officer
Job Summary:
- Responsible for providing legal service and support to Special Accounts Management Group (SAMG), to Consumer Lending Group (CLG), to Acquired Asset Management Disposition Division (AAMDD), IBS, Branches and Credit Investigation & Appraisal Division (CRIAD).
Role Exposure:
- Monitors assigned past due accounts/cases/ROPA matters involving foreclosure, collections, rehabilitation and/or liquidation proceedings, petitions for issuance of writs of possession, defensive suits, replevin and other cases, and when necessary, attends hearings and trials thereof.
- Monitors accounts/cases endorsed to, reviews the pleadings drafted by, and coordinates with the Bank’s retained counsels.
- Makes progress reports of cases and accounts being handled.
- Conducts legal due diligence, evaluates and reviews all documents of accounts being endorsed for legal actions and/or those referred/transferred/for booking to SAMG for the latter’s handling.
- Recommends or decides the appropriate remedial strategy or legal action to be taken on past due accounts and on accounts endorsed for litigation.
- Prepares/reviews all pleadings for cases being personally handled/monitored, including internal foreclosure.
- Coordinates with sheriffs & AAMDD and participates in the enforcement of writs of execution, possession or attachment.
- Drafts/reviews the necessary bank documents and agreements.
- Renders legal opinions on queries and makes recommendations on actions to be taken on past due accounts and on various institutional queries.
- Evaluates facts and evidence and researches on laws and jurisprudence to provide legal advice that shall support the Bank's claims and defenses
- Addresses all legal risk-related matters which are potential litigation issues.
- Provides legal service and support to the Bank’s different departments, particularly to SAMG, CLG, IBS, Credit, Branches and AAMDD.
- Renders other appropriate legal service/s as the need arises, or as may be especially assigned from time to time.
- Performs other related functions that may be assigned from time to time
Qualifications:
- Registered Lawyer
- Minimum of 2 years as a lawyer; substantial experience in litigation is required
- Banking experience is an advantage but not required
